2012 Ontario Higher Education Risk Management Symposium

The 2012 Ontario Higher Education Risk Management Symposium (aka: the Ontario Universities Risk Management Workshop) will be held at the Donald Gordon Centre, Queen's University at Kingston on May 28-30.   A limited number of hotel rooms are available at the Donald Gordon Centre (DGC).  Those interested in staying on site are asked to contact the DGC directly at: 613.533.2221. Please use, "2012 Ontario Higher Education Risk Management Symposium May 28-30" as the booking reference.   It is recommended that you reserve your room as soon as possible. More details to follow in the new year but in the meantime if you have a topic that you would like to discuss or present at next year's symposium, please feel to send an email to any of the Chairs below. Waiver of Liability and Assumption of Risk Agreement Enforced

When will a waiver be enforced?  The attached article reviews the recent decision in Loychuk and Westgeest v. Cougar Mountain Adventures Ltd. in which the RMS member firm Lindsey Kenney LLP successfully argued the enforceability of a Waiver of Liability and Assumption of Risk Agreement and had the plaintiff's claims for personal injuries dismissed with respect to an accident which occurred on the defendants zipline.

Japan Earthquake March 2011

Guy Carpenter has produced an updated CAT-i report on the powerful earthquake that struck off the coast of northeastern Japan on 11 March. Both the U.S. Geological Survey (USGS) and the Japanese Meteorological Agency (JMA) have recently upwardly revised their measurements of the earthquake’s magnitude to 9.0, making it the fourth most powerful earthquake in the world since 1900 and the largest in Japan’s history. Emerging reports indicate widespread property damage across northern Japan. Fears over the fate of the Fukushima Daiichi nuclear plant have increased. Three explosions and a fire have hit the facility over the last few days, seemingly causing radioactive leaks. Indeed, Japan’s government has announced this morning that radiation from the plant has now reached harmful levels.
